Government Publishes Guidance on Agency Workers Regulations

The Government has published its guidance on the Agency Workers Regulations today, in advance of them coming into force on 1st October 2011.

The regulations will provide agency workers with the same basic working and employment conditions as if they had been hired directly, after working for the same hirer for 12 consecutive weeks. This covers:

  • pay;
  • the duration of working time;
  • night work;
  • rest Periods;
  • rest breaks; and
  • annual leave

and will be judged against the terms and conditions that are ordinarily included in the hirer’s employment or other contracts for their own workers.
