Serial Litigants Risk Costs Awards

Serial litigants – like John Berry, who has brought numerous claims against employers that advertise vacancies with terms such as “school leavers” or “recent graduates” – risk costs being awarded against them in the future.

In a recent Employment Appeal Tribunal judgment involving Mr Berry, Underhill P warned that claimants who bring age discrimination claims in respect of allegedly discriminatory job advertisements in which they have no genuine interest purely in the hope of being paid off are liable to face an order for costs.
