Employment Tribunals – Compensation Limit Increase

Compensation in some employment tribunal claims will increase by 4.6% from February 2011, bringing the compensatory award for an unfair dismissal to a potential maximum of £68,400. With a basic award of 30 week’s pay at an increased £400 limit, an unfair dismissal could cost an employer £80,400.

The minimum compensation will be increased to £5,000 for cases where dismissal is unfair by virtue of involvement/activity in a trade union, health and safety, occupational pension scheme trustee, employee representative, or working time grounds.

Where dismissal – or disciplinary action short of dismissal – is deemed necessary by an employer, taking professional advice first has to be considered. Contact Employment Law Clinic.
